the day MS sues anyone - either Novell will cover you, or Novell will lose their rights to distribute this code under GPLv2 clause 7.
Which probably means - either Novell covers everyone , or they will terminate their contract with Microsoft on that day, and in consequence probably Novell patents will be used against MS.
